Maxwell Forest Pty Ltd and its affiliates (“Maxwell Forest”, “we”, “us”, “our”) is committed to protecting the privacy of individuals. This Privacy Policy describes Maxwell Forest’s privacy practices in relation to the collection, use and disclosure of information it gathers from your (“you”, “your”, “user”, “user’s”, “users”) use of the Onefill website and the websites listed below, at Section 1.1 (hereinafter referred to as the “Site” or the “Sites”) and any other interactions you have with us through other written, oral or digital channels.

By accessing or using the Sites, making contact with our call centres or providing Maxwell Forest with any information through other written, oral or digital channels, you agree to the information practices outlined in this Privacy Policy.

1.0 Included websites

The Sites may contain, display or make references to links to third party materials and websites not controlled by Maxwell Forest. Maxwell Forest provides such information and links as a convenience to you and such links and references should not be considered endorsements or recommendations of such websites or any content, productions or information offered on such websites. You acknowledge and agree that Maxwell Forest is not responsible for any aspect of the information or content contained in any third party materials or websites accessible via or linked from the Sites.

2.0 Collected information

2.1 User-provided Information

When requesting additional information about Onefill, or making an enquiry via the Site’s contact form or email, accessing or using the Site or interaction with our call centre, Maxwell Forest or a third party working on our behalf and providing services to us, requires you to disclose personally identifiable information (PII) including, but not limited to: your name, business or company name, home or business address, phone number, email address.

Maxwell Forest, or a third party working on our behalf and providing services to us, may also ask you to provide additional information for the purposes of billing such as your credit card details, mobile contact number and billing address.

2.1.1 Sole responsibility for use of Maxwell Forest Sites and content

When using the Sites you are responsible and liable for the accuracy of any data or information, including PII, provided and transmitted by you. Any information you provide on, to or via the Sites will be assumed to be reliable, accurate, complete and up-to-date.

2.1.2 Children’s use of the Maxwell Forest Sites

It is not our intention to collect any personal information from children. Accordingly, you must be at least 18 years old (or the relevant age of majority applicable to you where you live if that is not 18 years of age), to register on our Sites. In addition, our Sites are not directed at, nor intended for children under the age of 13. If we learn that we have collected PII of a child under 13 we will take steps to delete such information from our files as soon as possible. If we become aware that you are under the necessary age limit to register on our Sites, we will take action to delete your account and remove any PII obtained. 2.2 Automatically Collected Information

When using the Sites, PII may be automatically recorded from a user’s device by Maxwell Forest using a variety of common information gathering tools, including (but not limited to) cookies, web beacons and clear gifs. Automatically collected information may include a user’s Internet Protocol (IP) address or other device related address(es), web browser and/or device type, referring website addresses, and dates and times of access. We may also collect information regarding interactions you have with us via email messages, including whether an email sent by Maxwell Forest was opened, read and/or forwarded. Such information is collected from all users without discrimination, and is used to improve and maintain the quality of the Sites and your interaction with us via the Sites.

2.2.1 Cookies

When you visit any of the Sites, our servers send a ‘cookie’ to your computer’s hard drive. If your browser is set to accept cookies, it will accept the cookie sent by our Sites. We do not use our cookies to read any information on your computer’s hard drive other than information relating to your use of our Sites. Standing alone, cookies do not personally identify you; they identify your web browser. Unless you choose to identify yourself on the Sites by means of opening an account, filling out a contact form or responding to a promotional offer, you remain personally anonymous.

We use cookies to remember you and track your preferences so that we may be able to better customize services for you when you return to our Sites. Information garnered from cookies also enables us to improve and maintain the usability of the Sites.

Our cookies are both session-based and persistent-based. Session cookies are used on a per-session basis only, and disappear from your computer when you close your browser or shut down your computer. Persistent cookies remain on your computer after you close your browser or shut down your computer.

You can block cookies on your web browser. Please note that if you disable your browser’s ability to accept cookies, your ability to successfully use some of the features of the Sites may be compromised.

We also note that we may enable third party providers to incorporate links within our Sites and these links may also incorporate cookies. Maxwell Forest does not have access or control over any cookies that third party sites may use and their use is not covered by this Privacy Policy.

2.3 Integrated Services

During your use of the Sites you authorize us to connect with a third party Integrated Service in relation to your personal information or any other information provided by you. By authorizing us to connect with an Integrated Service, you authorize us to share your name, email address(es), date of birth, gender, location and any other information that is provided to us by you. In particular, you acknowledge and accept that we may use and disclose such information in accordance with this Policy to the following third parties:

  • MailChimp®
  • Webhook
  • Wufoo
  • Mixpanel Inc.

An Integrated Service may: (a) use user data internally to provide and improve its services; (b) to the extent permitted by law, use, sell, license and distribute and disclose Aggregated Data; (c) perform fraud screening, verify identities, and verify information contained in accounts. Integrated Services will not disclose user specific data to any other third party or use the data to directly solicit customers.

Maxwell Forest may make certain automatically-collected and aggregated information available to third parties for a range of purposes, including: (i) reporting and compliance obligations; (ii) marketing and business operations; and (iii) to assist third parties in the provision of certain services, functionality, content, programs and advertising.

When you are referred to an external Integrated Service provider either via the Sites or as part of a Maxwell Forest product offering (including those Integrated Service providers outlined below), it is your responsibility to check your privacy settings with the relevant external Integrated Service provider to understand and control the information that may be shared with them. It is important that you read and understand the terms of use and privacy policies of each Integrated Service you interact with before using their services and connecting with Maxwell Forest via our Sites. The Service providers we use might change from time to time.

2.3.1 MailChimp®

Our mail distribution list is stored on a secure MailChimp server. If someone on our list complains or contacts MailChimp®, MailChimp® may then contact that person. Only authorized employees have access to view Distribution Lists. MailChimp® use and disclose the information in our distribution list only for the reasons defined in their Privacy and Terms of Service policies.

2.3.2 Webhook

Webhook is a rapid development tool designed to assist in the building of complex, content editable web sites. The Onefill website is hosted on Webhook Inc. They provide us with an online platform that allows us to promote our product and services to you.

Your data is stored through the Webhook data storage databases and the general Webhook application. They store your data on a secure server behind a firewall.

2.3.3 Wufoo

Wufoo collects email data. You may choose to submit your email address via a submission form located on our Site. Your email address may be used to send you news about Onefill related services. We may use one or more service providers to administer these messages, but we do not share your email address with spammers or any other third parties without your permission.

2.3.4 Google Analytics (Google)

Google Analytics is a web analysis service provided by Google Inc. ("Google"), Google Analytics uses cookies to help us analyze how users use our Website, to prepare reports on website activity. As a rule, any information generated by the cookies about your use of our website will be transmitted to and stored by Google on servers in the United States.

Google may also use the data collected to contextualize and personalize the ads of its own advertising network and/or share the data with other Google services.

You may opt-out from the collection of information stored and generated by the Google Analytics cookies as well as the use of such data by Google by downloading and installing the browser-plugin.

3.0 Use of information

3.1 User provided PII

Maxwell Forest or a third party working on our behalf and providing services to us, uses PII obtained in accordance with this Privacy Policy to (i) obtain and respond to registrations of interest in our products and services, (ii) collect payment for products and services, (iii) arrange for the delivery of our products and services, (iv) provide customer support, and (v) validate the identity of users for security purposes.

We use non PII information collected in accordance with this Privacy Policy to operate, maintain and improve our Sites and the provision of our products, services and information that users request, and to provide general support and responses to enquiries we receive from users.

We may also use non PII collected in accordance with this Privacy Policy to understand, analyze and record usage trends and preferences of our users for the purposes of quality assurance and product development.

In addition, Maxwell Forest may use your email address or other information collected in accordance with this Privacy Policy to:

I. Contact you for administrative and support purposes (including account queries);
II. Address intellectual property infringement, right of privacy violations or defamation issues related to any content (“User Content”) posted by you on the Site;
III. Send communications to you including updates on orders and promotional information relating to products and services offered by Maxwell Forest and any affiliated third parties; or to
IV. Send you any notices required by law in lieu of communication by postal mail.

You have the ability to opt-out of receiving any unsolicited promotional communications from us at any time, by using the unsubscribe link at the bottom of the relevant email.

3.2 Automatically collected PII

Automatically collected PII obtained from your use of the Sites is used to:

I. Personalize our service offering (e.g. retaining user information for the purposes of autofill);
II. Provide customized advertisements, content and information pertinent to our business; and
III. Track your entries, submissions and status in any promotional or customer service activities.

In addition, our servers automatically record certain information about how a person uses our Sites (we refer to this information as “Log Data”). Log Data may include information such as a user’s Internet Protocol (IP) address, browser type, operating system, the web page that a user was visiting before accessing our Sites, the pages or features of our Sites to which a user browsed and the time spent on those pages or features, the search terms generated by a user, the links on our Sites that a user clicked on and other statistics. We use Log Data to administer the Sites and related services and we analyze (and may engage third parties to analyze), Log Data to improve, customize and enhance our Sites and related sites by expanding their features and functionality and tailoring them to our users’ needs and preferences.

4.0 Disclosure of information

We will not share any PII that we have collected from or regarding you except as described below:

Information Shared with Our Services Providers. We may engage third-party services providers to work with us to administer and provide the Sites and related services. These third-party services providers have access to your PII only for the purpose of performing services on our behalf and are expressly obligated via confidentiality requirements not to disclose or use your PII for any other purpose.

Information Shared with Third Parties. We may share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling and other similar purposes.

Information Disclosed for Our Protection and the Protection of Others. We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to respond to claims and other legal process (including subpoenas); (ii) to protect our property, rights and safety and the property, rights and safety of a third party or the public in general; and (iii) to stop any activity that we consider illegal, unethical or legally actionable activity.

Maxwell Forest cooperates with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate, in good faith, is appropriate or necessary to:

I. take precautions against liability;

II. protect our interests and those of others against fraudulent, abusive, or unlawful activities;

III. investigate and defend ourselves against claims or allegations made by third parties;

IV. protect the security and integrity of the Sites, including any facilities and equipment used to make the Sites available; or

V. to protect our proprietary and other legal rights, including our intellectual property rights, enforcement of our agreements, or the rights, property and safety of Maxwell Forest, our users or others.

Your information may, in future, be disclosed and otherwise transferred to an acquirer, successor or assignee as part of a merger, acquisition or sale of asset or business, as well as in the event of receivership, dissolution or similar event in which information is transferred to one or more third parties as part of our business assets.

Under no circumstances will Maxwell Forest share, sell, rent or trade any of your PII with third parties specifically for their promotional purposes.

4.1 International transfer of collected information

The Sites are primarily intended for visitors located within the United States. If you choose to access the Sites from a different region of the world, where laws governing data use and collection may be different, you consent to the transfer of your PII to the United States and other countries including to Australia for processing. Maxwell Forest may also transfer your data outside of the United States for the purposes of data processing and storage, fulfilment, and provision of services. By providing any information to Maxwell Forest through your use of the Sites you consent to such transfer, storage and processing.

It is possible that certain jurisdictions in which your PII is stored are subject to legal based data access requests by / from governmental authorities, Courts of Law or law enforcement agencies. By using our Sites, you consent to the transfer of your PII as a result of such access requests where Maxwell Forest is legally compelled to do so.

This Privacy Policy will apply even if information is transferred across jurisdictions.

5.0 User preferences

Maxwell Forest customers, clients and other end users have the ability to choose how we use any information provided to us through the use of the Sites.

You may manage your receipt of marketing and non-transactional communications from us by clicking ‘Unsubscribe’ at the bottom of Maxwell Forest marketing emails. Please note that if you opt-out of receiving promotional email from us or otherwise modify the nature or frequency of communications you receive from us, it may take up to ten business days to process your request and you may receive promotional communications during that period. As a user of our Sites, you will continue to receive administrative messages from Maxwell Forest even if you opt out of receiving promotional or marketing communications.

You may decline to share certain PII with us, in which case we will not be able to provide you with certain information, products or services.

If you wish to review or amend any of your PII we may be holding, or wish to request that we delete any of your PII that we have obtained from an Integrated Service, you may do so by contacting us at

Please note that we may retain all information that you submit to us via the Sites for backup, archiving, fraud prevention, analytics, and legal purposes, or for any other purpose that we believe to be reasonably necessary and legitimate.

6.0 Data security

Maxwell Forest is committed to the security of your information and has in place a number of technical and procedural safeguards designed to protect PII against foreseeable hazards such as (but not limited to) unauthorized access, software contamination, computer hacking, destruction, misuse, modifications and improper disclosure.

Our Sites are protected by a comprehensive set of security measures to provide a reasonably high level of protection. However, no system is perfect and Maxwell Forest cannot ensure the security of any information transmitted via our Sites. By using our Sites you accept the inherent security risk of transmitting information over the internet and acknowledge that Maxwell Forest is not liable in any event of a third party breach of security.

Maxwell Forest is not responsible for the security practices used by third party websites linked to and from within our Sites. As soon as you link to another third party website, our Privacy Policy ceases to apply and you are responsible for determining that website’s data security and privacy policies.

It is also your responsibility to securely store and / or safeguard any password, user ID or any other PII you use to access our Sites.

You should also be aware that when PII is voluntarily disclosed by you (i.e. your name, email address etc.) in any public areas on our Sites, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond our control and this Privacy Policy does not apply to such information.

7.0 Responding to do not track signals

Our Sites do not have the capability to respond to “Do Not Track” signals received from various web browsers.

8.0 Privacy rights

8.1 Your California Privacy Rights

California residents may request and obtain from us, once a year, free of charge, a list of third parties, if any, to which we disclosed their PII for direct marketing purposes during the preceding calendar year and the categories of PII shared with those third parties. As an Australian resident, you may request Maxwell Forest to provide access to the PII it holds about you. Maxwell Forest will respond to that request where it is reasonable and lawful to do so. 9.0 Changes to this privacy policy

Maxwell Forest reserves the right to change this Privacy Policy at any time. We will provide reasonable notification of any material changes to the Privacy Policy through our Sites. In addition, if you a registered user of our Site, we will notify you by issuing an email to the email address listed by you. You should maintain a valid email address as a registered user of our Site, if you wish to be notified of changes to our Privacy Policy, and otherwise should periodically review our Privacy Policy to ensure you are up to date with Maxwell Forest’s Privacy based information practices. Your continued use of the Sites, call centres or other interactions with us after any revision has become effective indicates that you have read, understood and agreed to the then current version of the Privacy Policy.
